The Supreme Court on Wednesday refused to accept the affidavit filed by yoga guru Ramdev and Patanjali Ayurveda Managing Director Balkrishna in which they had tendered unconditional apology for publishing a “misleading” advertisement, saying they had taken a “wrong step.” “But I did this when I was caught.

The court has also strongly reprimanded the state licensing authority for inaction on the issue and said it will not take it lightly. A bench of Justice Hima Kohli and Justice Ahsanuddin Amanullah came down with an unusually strong rebuke.

The top court observed that when show cause notices were issued to them and they were directed to appear before the court, Ramdev and Balakrishna “attempted to get out” of the situation where personal presence was mandatory. This, the court said, was “most unacceptable”.

“Considering the entire history of the case and past conduct of the contemnors, we have expressed our reservations about accepting the latest affidavit filed by them,” the bench said while pronouncing the order in the courtroom.

The court has fixed the case for re-hearing on April 16.

Slamming the authority, the top court said, we are surprised to note that apart from forwarding the files, the state licensing authority did nothing and remained in “deep sleep” on the issue for four-five years.

It asked the state official present on behalf of the authority to explain the reason for inaction.

The bench refused to accept the apology of Ramdev and Balakrishna, saying, “We do not want to be so lenient in this matter.”
