Why arrest before general elections, how Kejriwal is involved in the case? Supreme questioned ED. Today again a hearing was held in the Supreme Court on the petition challenging the arrest of Delhi CM Arvind Kejriwal. During this, SC has sought answers from ED on some questions including the timing of Arvind Kejriwal’s arrest just before the general elections.

During the hearing in the Supreme Court, Justice Khanna said that freedom is very important, you cannot deny it. Then finally Justice Khanna said the timing of the arrest is just before the general elections.

The top court asked the ED to explain the time gap between its response and initiation of proceedings and the repeated complaints being filed after some time. ED will also have to answer whether any judicial proceedings are going on, whether you can initiate criminal proceedings.


This hearing is going on in the court from Monday. Yesterday, Abhishek Manu Singhvi argued that ED arrested Kejriwal after the implementation of the Model Code of Conduct. Either he has enough evidence, or there is some basis of which we do not know. The statements on the basis of which Kejriwal has been arrested are 7 to 8 months old. Raghav Magunta gave 4 statements – All the statements cannot be trusted. If ED feels that Arvind Kejriwal is guilty in the case, then why did the investigating agency let him roam free for so long?

In his petition, Mr Kejriwal has argued that his arrest is illegal and so is his custody. Its motive was political, made clear by the timing – ahead of the general elections. “The attempt is to decimate a political party and topple an elected government of the NCT of Delhi,” his plea read.

During Monday’s hearing, his counsel Abhishek Manu Singhvi told the court that one can be arrested only on evidence of guilt, “not mere suspicion“. “This is also the threshold in Section 45 PMLA (law against money laundering),” he had said, pointing out that the investigating agency had not recoded the statement of the Delhi Chief Minister.
